Emissione
La Gift Card è emessa da DEL.COM. S.r.l., società a socio unico, con sede legale in Via Filippo Della Valle, 1 – 63811 Sant’Elpidio a Mare (FM) - Italia – Capitale Sociale € 31.200 i.v., R.I. n. 00520770447 FM (di seguito per brevità l’“Emittente”)”.
La Gift Card viene emessa ed attivata presso uno dei punti vendita partecipanti gestiti dall’Emittente, previo versamento – in contanti o con altre modalità di pagamento accettate dal punto vendita - di un importo massimo di € 3.000,00 (tremila/00 Euro). Nessun costo aggiuntivo viene richiesto per l’attivazione e l’utilizzo. I punti vendita partecipanti sono quelli di Milano, Roma, Firenze, Venezia.
Dopo averla attivata in cassa, versando l'importo prescelto, il Cliente riceverà una ricevuta di emissione con l'indicazione dell'importo caricato. L'importo caricato sulla Gift Card non matura interessi.
Natura
La Gift Card è un buono acquisto a scalare e, quale titolo di legittimazione, assume natura di ”mera movimentazione di carattere finanziario”; la relativa somma versata sarà in esenzione IVA in quanto l’operazione si configura come cessione di denaro.
La Gift Card è un titolo di credito al portatore ed è, come tale, equiparabile al denaro contante. Per tale motivo la Gift Card va conservata con estrema cura in quanto può essere utilizzata da qualsiasi persona che ne entri in possesso. I punti vendita non hanno l’obbligo di verificare l’identità della persona che usa la carta. Si declina esplicitamente qualsiasi responsabilità dell’Emittente o dei punti vendita partecipanti in relazione, a titolo meramente esemplificativo e non esaustivo, all’uso improprio, al furto o allo smarrimento della carta; tali circostanze non comportano la sostituzione o il rimborso del credito disponibile.
Utilizzo
La Gift Card è destinata esclusivamente all'acquisto, in una o più soluzioni, di prodotti presso tutti i punti vendita partecipanti all'iniziativa gestiti dall’Emittente.
La Gift Card può venir utilizzata per più acquisti fino a completo esaurimento del credito contenuto o a parziale pagamento di un acquisto. Ogni qualvolta la Gift Card venga utilizzata, il credito viene scalato dell’importo corrispondente e l’eventuale residuo rimane disponibile per gli acquisti futuri. Se il credito disponibile sulla Gift Card non è sufficiente a coprire l’importo dell’acquisto è possibile integrarne l’utilizzo con le altre modalità di pagamento accettate dal punto vendita.
Il saldo figurerà di volta in volta sullo scontrino di cassa emesso al momento di un acquisto mediante l'utilizzo della Gift Card.
Scadenza
La Gift Card potrà essere utilizzata per la durata di 12 mesi decorrenti dalla sua attivazione, la cui data è stampata sulla ricevuta di emissione della carta stessa. Dopo la data di scadenza, la Gift Card non potrà più essere utilizzata né ricaricata, né il portatore avrà diritto ad alcuna forma di rimborso del credito residuo.
Legge regolatrice
L'acquisto e l'uso della Gift Card implicano l'accettazione dei presenti termini e condizioni di utilizzo. L'Emittente conserva il diritto di modificare e/o emendare, a propria discrezione e in qualsiasi momento, i presenti termini e condizioni.
Ogni controversia relativa all'utilizzo della Gift Card sarà regolata dalla legge italiana.
GIFT CARDS – USAGE TERMS AND CONDITIONS
Issue
The Gift Card is issued by DEL.COM. S.r.l., a company duly incorporated in Italy with registered office at no. 1, Via Filippo Della Valle – 63811 Sant’Elpidio a Mare (FM) - Italy – Fully paid up capital € 31.200, R.I. n. 00520770447 FM (hereinafter referred to as the “Issuer”).
The Gift Card is issued and activated solely at such sales points participating in the initiative as identified by the Issuer and upon payment, in cash or by any other means of payment accepted by the said sales point, of a an amount up to € 3,000.00 (Three Thousand/00 Euro). No additional cost is requested for activation and use. The participating sales points are the following: Milan, Rome, Florence, Venice.
After activating the Gift Card at the cash desk of the aforementioned sales points and having paid the chosen amount, the Customer will be given an issue receipt indicating the amount available on the Gift Card. No interest shall accrue on the amount available on the Gift Card.
Type
The Gift Card is a voucher with a value that progressively decreases as the Gift Card is used, acting as a simple financial transaction; the concerned sum paid for the Gift Card is exempt from VAT since the operation is classified as a transfer of cash.
The Gift Card represents the holder’s right to credit and, as such, it is equivalent to cash. For this reason, the Gift Card must be kept with great care, since it can be used by anyone who obtains possession of it. The sales points as listed hereinabove are not obliged to check the identity of the person using the Gift Card. The Issuer and the said sales points explicitly decline all liability, for example, but not limited to, the event of improper use, theft, or loss of the Gift Card.In such circumstances, the Gift Card will not be replaced and the available credit therein will not be reimbursed but permanently forfeited.
Use
The Gift Card shall be used exclusively for the purpose of buying products, in one or more transaction, from the Issuer’s designated sales points which participate in the initiative.
The Gift Card can be used for purchases until the credit available on the card is completely used up, or for the partial payment of a purchase. Every time the Gift Card is used, the credit will be decreased by the amount of purchase, and any remaining credit will be available for future purchases. If the credit available on the Gift Card is not enough to cover the amount of the purchase, the difference can be paid by any other means accepted by the concerned sales point.
Every time the Gift Card is used, the remaining balance therein will be printed on a receipt to be issued for the respective purchase.
Expiry
The Gift Card can be used for twelve (12) months starting from the time of activation, being the date printed on the receipt for the issue of the Gift Card itself. After the expiry date, the Gift Card cannot be longer used or re-charged, and the holder will have no right to the reimbursement of any residual credit thereinto.
Governing law
The purchase and use of the Gift Card implies the acceptance of the aforementioned terms and conditions of use. The Issuer reserves the right to modify and/or amend these terms and conditionsat any time at its own discretion.
Any dispute arising out of or in connection with the use of the Gift Card shall be governed by Italian law.

The Gift Card is issued and activated solely at such sales points participating in the initiative as identified by the Issuer and upon payment, in cash or by any other means of payment accepted by the said sales point, of a an amount up to € 3,000.00 (Three Thousand/00 Euro). No additional cost is requested for activation and use. The participating sales points are the following: Tod's Bruxelles.
After activating the Gift Card at the cash desk of the aforementioned sales points and having paid the chosen amount, the Customer will be given an issue receipt indicating the amount available on the Gift Card. No interest shall accrue on the amount available on the Gift Card.

GESCHENKBON - Algemene gebruiksvoorwaarden
UITGIFTE
Deze Geschenkbon wordt uitgegeven door TOD'S BELGIQUE SPRL., gevestigd te nr. 46 de BOULEVARD DE WATERLOO – 1000 BRUXELLES, Belgique (hierna te noemen "de Uitgever").
De Geschenkbon wordt uitsluitend uitgegeven en geactiveerd in verkooppunten die deelnemen aan het initiatief, zoals vastgesteld door de Uitgever, en tegen betaling in cash geld of een ander door het verkooppunt aanvaard betaalmiddel, voor een maximum bedrag van EUR 3.000,00 (drieduizend EURO). Er worden geen extra kosten in rekening gebracht voor de activering en het gebruik ervan. De deelnemende verkooppunten zijn: Tod's Bruxelles.
Na activering van de Geschenkbon bij de kassa van de hierboven genoemde verkooppunten en na betaling van het gekozen bedrag, krijgt de klant een ontvangstbewijs waarop het beschikbare krediet van de Geschenkbon is vermeld. Er is geen rente verschuldigd op het beschikbare krediet op de Geschenkbon.
TYPE
De Geschenkbon is een tegoedbon waarvan de waarde geleidelijk afneemt naarmate de Geschenkbon wordt gebruikt en dient als een eenvoudige financiële transactie. Op het aankoopbedrag van de Geschenkbon is geen BTW verschuldigd omdat de transactie wordt aangemerkt als een cash betaling.
De Geschenkbon geeft de houder recht op krediet en is, als zodanig, gelijk aan contant geld. Daarom is het belangrijk dat er zorgvuldig met de Geschenkbon wordt omgegaan, want deze kan door iedereen worden gebruikt die hem in zijn of haar bezit krijgt. De hierboven genoemde deelnemende verkooppunten zijn niet verplicht om de identiteit te controleren van de persoon die de Geschenkbon gebruikt. De Uitgever en de genoemde verkooppunten wijzen nadrukkelijk alle aansprakelijkheid af, bijvoorbeeld, maar niet enkel, in gevallen van oneigenlijk of illegaal gebruik, diefstal of verlies van de Geschenkbon. In dergelijke gevallen wordt de Geschenkbon niet vervangen en wordt het beschikbare krediet daarop niet vergoed, maar permanent verbeurd verklaard.
GEBRUIK
De Geschenkbon kan uitsluitend gebruikt worden voor de aankoop van producten, in één of meer transacties, bij een door de Uitgever aangegeven verkooppunt dat deelneemt aan het initiatief.
De Geschenkbon kan worden gebruikt voor aankopen totdat het beschikbare krediet op de Geschenkbon volledig besteed is, of voor de gedeeltelijke betaling van een aankoop. Bij elk gebruik van de Geschenkbon zal het beschikbare krediet worden verminderd met het overeenkomstige bedrag van de aankoop en blijft het eventueel resterende krediet beschikbaar voor toekomstige aankopen. Als het beschikbare krediet op de Geschenkbon onvoldoende is om het bedrag van de aankoop te dekken, kan het verschil cash betaald worden of met een ander door het verkooppunt aanvaard betaalmiddel.
Bij elk gebruik van de Geschenkbon zal het resterende krediet op het ontvangstbewijs van de betreffende aankoop worden afgedrukt.
VERVALDATUM
De Geschenkbon kan gedurende twaalf (12) maanden gebruikt worden vanaf het moment van activering, meer bepaald vanaf de datum vermeld op het ontvangstbewijs van de uitgifte van de Geschenkbon zelf. Na de vervaldatum kan de Geschenkbon niet meer gebruikt of opgeladen worden en heeft de houder geen recht op terugbetaling van het eventueel resterende krediet op de Geschenkbon.
TOEPASSELIJK RECHT
De aankoop en het gebruik van de Geschenkbon houdt in dat de hier genoemde algemene gebruiksvoorwaarden worden aanvaard. De Uitgever behoudt zich het recht deze algemene gebruiksvoorwaarden op elk moment naar eigen goeddunken te wijzigen.
Op de eventuele geschillen die voortvloeien uit of verband houden met het gebruik van de Geschenkbon is het Belgische wetgeving van toepassing.
CARTES CADEAU - CONDITIONS GÉNÉRALES D'UTILISATION

La Carte Cadeau est émise par TOD'S BELGIQUE SPRL, une société dûment constituée en Belgique, dont le siège social est sis au n. 46 de BOULEVARD DE WATERLOO – 1000 BRUXELLES, Belgique (ci-après désignée par « l'Émetteur »)
La Carte Cadeau est émise et activée uniquement dans les point de vente participant à l'initiative, tels qu'identifiés par l'Émetteur, et sur paiement, en espèces ou par tout autre moyen de paiement accepté par ledit point de vente, d'un montant maximal de 3 000,00 € (trois mille/00 euros). Aucun frais supplémentaire n'est demandé pour l'activation et l'utilisation. Les points de vente participants sont les suivants : Tod's Bruxelles.
Après avoir activé la Carte Cadeau à la caisse de l'un des points de vente ci-dessus mentionnés, et avoir payé le montant choisi, le Client recevra un reçu d'émission indiquant le montant disponible sur la Carte Cadeau. Aucun intérêt ne sera échu sur le montant disponible sur la Carte Cadeau.
Type
La Carte Cadeau est un bon cadeau dont la valeur diminue progressivement au fur et à mesure que la Carte Cadeau est utilisée, servant en cela de simple transaction financière ; le montant correspondant payé pour la Carte Cadeau est exempt de TVA puisque l'opération est classée en tant que transfert de fonds.
La Carte Cadeau représente le droit du détenteur à un avoir, et, en tant que telle, est équivalente à des espèces. Pour cette raison, la Carte Cadeau sera conservée avec le plus grand soin, car elle peut être utilisée par toute personne en sa possession. Les points de vente mentionnés ci-dessus ne sont pas tenus de vérifier l'identité de la personne utilisant la Carte Cadeau. L'Émetteur et lesdits points de vente rejettent explicitement toute responsabilité, par exemple, et sans limitation, en cas d'utilisation abusive, vol, ou perte de la Carte Cadeau. Dans ces circonstances, la Carte Cadeau ne sera pas remplacée et l'avoir disponible sur celle-ci ne sera pas remboursé mais sera définitivement caduc.
Utilisation
La Carte Cadeau sera utilisée exclusivement afin d'acheter des produits, dans le cadre d'une ou plusieurs transactions, auprès des points de vente désignés par l'Émetteur qui participent à l'initiative.
La Carte Cadeau peut être utilisée pour les achats jusqu'à ce que l'avoir disponible sur la carte soit complètement utilisé, ou pour le paiement partiel d'un achat. Chaque fois que la Carte Cadeau est utilisée, l'avoir sera réduit du montant correspondant de l'achat, et l'avoir restant sera disponible pour les futurs achats. Si l'avoir disponible sur la Carte Cadeau n'est pas suffisant pour couvrir le montant de l'achat, la différence peut être payée par tout autre moyen de paiement accepté par le point de vente concerné.
Chaque fois que la Carte Cadeau est utilisée, le solde restant sur celle-ci sera imprimé sur le reçu émis pour l'achat correspondant.
Date d'expiration
La Carte Cadeau peut être utilisée pendant douze (12) mois à partir de l'activation, s'agissant de la date imprimée sur le reçu pour l'émission de la Carte Cadeau elle-même. Après la date d'expiration, la Carte Cadeau ne peut plus être utilisée ou rechargée, et le détenteur n'aura aucun droit au remboursement de tout avoir résiduel sur celle-ci.
Droit applicable
L'achat et l'utilisation de la Carte Cadeau impliquent l'acceptation des conditions générales d'utilisation mentionnées ci-dessus. L'Émetteur se réserve le droit de modifier et/ou amender les présentes conditions générales à tout moment, à son entière discrétion.
Tout litige résultant de ou en relation avec l'utilisation de la Carte Cadeau sera régi par le droit belge.

發行
本禮品卡由Tod’s Hong Kong Limited（下稱“發行人”）發行，發行人是在香港特別行政區妥善設立之公司，註冊地址在香港銅鑼灣希慎道33號利園3501、3502 及3503室。
本禮品卡僅由發行人指定的參與該項活動的銷售點發行和激活；一旦以現金或該銷售點接受的其它支付方式付款後，本禮品卡的最高金額將不超過港幣30,000元。激活和使用該禮品卡無需支付任何額外的費用。 參與該活動的銷售點為以下各店：（1）置地廣場Tod’s店（中環）；（2）太古廣場Tod’s 店（金鐘）；（3）利園Tod’s 店（銅鑼灣）；（4）海港城Tod’s 店（尖沙嘴）及（5）圓方廣場Tod’s 店（九龍站）。如需取得各參與銷售點的最新名單及完整地址，請登錄網址www.tods.com查看。
在以上任何銷售點的收銀台激活該禮品卡、並支付所選的金額後，客戶將獲發一張發卡收據，顯示禮品卡可用金額。 禮品卡內可用金額不產生利息。
類型
本禮品卡為有價憑證，隨著卡的使用餘額逐漸減少。
本禮品卡代表客戶持卡人的信用權利，因此它等同于現金。鑒於獲得該卡的任何人士均可使用，故禮品卡須悉心保管。
上述所列各銷售點均無義務對使用該禮品卡的人士的身份進行檢查。 有關該禮品卡的所有責任，例如（包括但不限於）禮品卡的不當使用、被盜或丟失等情況，發行人及上述各銷售點特此明確概不負責。 如發生前述情況的，則該禮品卡將無法替換，且卡內的可用信用額將不予返還且將會被永久地沒收。
使用
本禮品卡僅可用于從發行人指定參與該活動的銷售點內一次或多次購買商品。
本禮品卡可用於購物，或作為購物款的部分付款，直至其可用信用額被完全地用盡為止。 每用一次卡，卡內的可用信用額將相應減少， 餘額則可用於下次購物。 若禮品卡內的可用餘額不足於支付購物款項，則客戶可以相關銷售點所接受的的任何其它付款方式支付差額。
每次使用禮品卡後，卡內餘額將列印在該次購物所簽發的收據上。
有效期
本禮品卡從激活之日，即發卡收條上所列印的日期起算十二（12）個月內可使用。 到期屆滿後，禮品卡不得再使用或充值，屆時客戶或持卡人無權要求返還/使用卡內的任何餘額。
適用法律
禮品卡的購買和使用默示地表明客户接受上述規定的使用條款和條件。 發行人保留在任何時候根據其自身的酌情權修訂和/或修改該等條款和條件的權利。
因禮品卡的使用引起的或與之有關的任何糾紛受香港特別行政區法律的管轄。

Any dispute arising out of or in connection with the use of the Gift Card shall be governed by the law of the Macao Special Administrative region of the People's Republic of China.

發行
本禮品卡由Tod’s Macau Limitada（下稱“發行人”）發行，發行人是在澳門特別行政區妥善設立之公司，註冊地址在澳門新口岸宋玉生廣場263號中土大廈6樓N座。
本禮品卡僅由發行人指定的參與該項活動的銷售點發行和激活；一旦以現金或該銷售點接受的其它支付方式付款後，本禮品卡的最高金額將不超過澳門幣30,000元(MOP)。激活和使用該禮品卡無需支付任何額外的費用。參與該活動的銷售點為澳門一號廣場Tod’s店。如需取得各參與銷售點的最新名單及完整地址，請登錄網址www.tods.com查看。
在以上任何銷售點的收銀台激活該禮品卡、並支付所選的金額後，客戶將獲發一張發卡收據，顯示禮品卡可用金額。 禮品卡內可用金額不產生利息。
類型
本禮品卡為有價憑證，隨著卡的使用餘額逐漸減少。
本禮品卡代表客戶持卡人的信用權利，因此它等同于現金。鑒於獲得該卡的任何人士均可使用，故禮品卡須悉心保管。
上述所列各銷售點均無義務對使用該禮品卡的人士的身份進行檢查。 有關該禮品卡的所有責任，例如（包括但不限於）禮品卡的不當使用、被盜或丟失等情況，發行人及上述各銷售點特此明確概不負責。 如發生前述情況的，則該禮品卡將無法替換，且卡內的可用信用額將不予返還且將會被永久地沒收。
使用
本禮品卡僅可用于從發行人指定參與該活動的銷售點內一次或多次購買商品。
本禮品卡可用於購物，或作為購物款的部分付款直至其可用信用額被完全地用盡為止。每用一次卡，卡內的可用信用額將相應減少，餘額則可用於下次購物。若禮品卡內的可用餘額不足於支付購物款項，則客戶可以相關銷售點所接受的的任何其它付款方式支付差額。
每次使用禮品卡後，卡內餘額將列印在該次購物所簽發的收據上。
有效期
本禮品卡可使用直至卡內款額用盡為止。
適用法律
禮品卡的購買和使用默示地表明客户接受上述規定的使用條款和條件。 發行人保留在任何時候根據其自身的酌情權修訂和/或修改該等條款和條件的權利。
因禮品卡的使用引起的或與之有關的任何糾紛受澳門特別行政區法律的管轄。

The Gift Card is issued by Tod’s Singapore Pte. Limited, a company duly incorporated in Singapore with registered office at 10 Collyer Quay #10-01, Ocean Financial Centre, Singapore 049315 (hereinafter referred to as the “Issuer”).
The Gift Card is issued and activated solely at such sales points participating in the initiative as identified by the Issuer and upon payment, in cash or by any other means of payment accepted by the said sales point, of a an amount up to 5,000 Singapore Dollars (SGD). No additional cost is requested for activation and use. The participating sales point is the Paragon Tod’s Store (Orchard Road). After activating the Gift Card at the cash desk of the aforementioned sales points and having paid the chosen amount, the Customer will be given an issue receipt indicating the amount available on the Gift Card. No interest shall accrue on the amount available on the Gift Card.

The Gift Card is a voucher with a value that progressively decreases as the Gift Card is used, acting as a simple financial transaction; the concerned sum paid for the Gift Card is exempt from GST.
The Gift Card represents the Customer holder’s right to credit and, as such, it is equivalent to cash. For this reason, the Gift Card must be kept with great care, since it can be used by anyone who obtains possession of it.
The sales points as listed hereinabove are not obliged to check the identity of the person using the Gift Card. The Issuer and the said sales points explicitly decline all liability, for example, but not limited to, the event of improper use, theft, or loss of the Gift Card. In such circumstances, the Gift Card will not be replaced and the available credit therein will not be reimbursed but permanently forfeited.
USE
The Gift Card shall be used exclusively for the purpose of buying products, in one or more transaction, from the Issuer’s designated sales points which participate in the initiative.
The Gift Card can be used for purchases until the credit available on the card is completely used up, or for the partial payment of a purchase. Every time the Gift Card is used, the credit will be decreased by the amount of purchase, and any remaining credit will be available for future purchases. If the credit available on the Gift Card is not enough to cover the amount of the purchase, the difference can be paid by the Customer by any other means accepted by the concerned sales point.
Every time the Gift Card is used, the remaining balance therein will be printed on a receipt to be issued for the respective purchase.
EXPIRY
The Gift Card can be used for twelve (12) months starting from the time of activation, being the date printed on the receipt for the issue of the Gift Card itself. After the expiry date, the Gift Card can no longer be used or re-charged and the Customer holder will have no right to the reimbursement/use of any residual credit thereinto.
GOVERNING LAW
The purchase and use of the Gift Card implies the acceptance of the aforementioned terms and conditions of use. The Issuer reserves the right to modify and/or amend these terms and conditions at any time at its own discretion.
Any dispute arising out of or in connection with the use of the Gift Card shall be governed by Singapore law.

After activating the Gift Card at the cash desk of the aforementioned sales points and having paid the chosen amount, the Customer will be given an issue receipt indicating the amount available on the Gift Card. No interest shall accrue on the amount available on the Gift Card.

The Gift Card is available for purchase in India in Indian Rupees only. The Gift Card is a voucher with a value that progressively decreases as the Gift Card is used, acting as a simple financial transaction; the concerned sum paid for the Gift Card is exempt from VAT since the operation is classified as a transfer of cash.
The Gift Card represents the Customer holder’s right to credit and, as such, it is equivalent to cash. For this reason, the Gift Card must be kept with great care, since it can be used by anyone who obtains possession of it. However please note that the Gift Card is not a credit card, a charge card or a debit card linked to a bank account. The Issuer is not liable to provide any customer service or administrative functions in respect of the Gift Card.
The sales points as listed hereinabove are not obliged to check the identity of the person using the Gift Card. The Issuer and the said sales points in India explicitly decline all liability, for example, but not limited to, the event of improper use, theft, or loss of the Gift Card. In such circumstances, the Gift Card will not be replaced and the available credit therein will not be reimbursed but permanently forfeited.
USE

Aucun frais supplémentaire n'est demandé pour l'activation et l'utilisation. Les points de vente participants sont les suivants : Paris Faubourg Tod's, Paris Grenelle Tod's e St Tropez Tod's.
Après avoir activé la Carte Cadeau à la caisse de l'un des points de vente ci-dessus mentionnés, et avoir payé le montant choisi, le Client recevra un reçu d'émission indiquant le montant disponible sur la Carte Cadeau. Aucun intérêt ne sera échu sur le montant disponible sur la Carte Cadeau.

La Carte Cadeau est un bon cadeau dont la valeur diminue progressivement au fur et à mesure que la Carte Cadeau est utilisée, servant en cela de simple transaction financière ; le montant correspondant payé pour la Carte Cadeau est exempt de TVA puisque l'opération est classée en tant que transfert de fonds.
La Carte Cadeau représente le droit du détenteur à un avoir, et, en tant que telle, est équivalente à des espèces. Pour cette raison, la Carte Cadeau sera conservée avec le plus grand soin, car elle peut être utilisée par toute personne en sa possession. Les points de vente mentionnés ci-dessus ne sont pas tenus de vérifier l'identité de la personne utilisant la Carte Cadeau. L'Émetteur et lesdits points de vente rejettent explicitement toute responsabilité, par exemple, et sans limitation, en cas d'utilisation abusive, vol, ou perte de la Carte Cadeau. Dans ces circonstances, la Carte Cadeau ne sera pas remplacée et l'avoir disponible sur celle-ci ne sera pas remboursé mais sera définitivement caduc.
Utilisation
La Carte Cadeau sera utilisée exclusivement afin d'acheter des produits, dans le cadre d'une ou plusieurs transactions, auprès des points de vente désignés par l'Émetteur qui participent à l'initiative.
La Carte Cadeau peut être utilisée pour les achats jusqu'à ce que l'avoir disponible sur la carte soit complètement utilisé, ou pour le paiement partiel d'un achat. Chaque fois que la Carte Cadeau est utilisée, l'avoir sera réduit du montant correspondant de l'achat, et l'avoir restant sera disponible pour les futurs achats. Si l'avoir disponible sur la Carte Cadeau n'est pas suffisant pour couvrir le montant de l'achat, la différence peut être payée par tout autre moyen de paiement accepté par le point de vente concerné.
Chaque fois que la Carte Cadeau est utilisée, le solde restant sur celle-ci sera imprimé sur le reçu émis pour l'achat correspondant.
Date d'expiration
La Carte Cadeau peut être utilisée pendant douze (12) mois à partir de l'activation, s'agissant de la date imprimée sur le reçu pour l'émission de la Carte Cadeau elle-même. Après la date d'expiration, la Carte Cadeau ne peut plus être utilisée ou rechargée, et le détenteur n'aura aucun droit au remboursement de tout avoir résiduel sur celle-ci.
Droit applicable
L'achat et l'utilisation de la Carte Cadeau impliquent l'acceptation des conditions générales d'utilisation mentionnées ci-dessus. L'Émetteur se réserve le droit de modifier et/ou amender les présentes conditions générales à tout moment, à son entière discrétion.
Tout litige résultant de ou en relation avec l'utilisation de la Carte Cadeau sera régi par le droit français.

After activating the Gift Card at the cash desk of the aforementioned sales points and having paid the chosen amount, the Customer will be given an issue receipt indicating the amount available on the Gift Card. No interest shall accrue on the amount available on the Gift Card.

The Gift Card is a multi-purpose voucher with a value that progressively decreases as the Gift Card is used. Currently the sale of the multi-purpose Vouchers by us is not subject to VAT when issued. If there is a change in UK VAT law, we reserve the right to review this arrangement.

La Carte Cadeau sera utilisée exclusivement afin d'acheter des produits, dans le cadre d'une ou plusieurs transactions, auprès des points de vente désignés par l'Émetteur qui participent à l'initiative.
La Carte Cadeau peut être utilisée pour les achats jusqu'à ce que l'avoir disponible sur la carte soit complètement utilisé, ou pour le paiement partiel d'un achat. Chaque fois que la Carte Cadeau est utilisée, l'avoir sera réduit du montant correspondant de l'achat, et l'avoir restant sera disponible pour les futurs achats. Si l'avoir disponible sur la Carte Cadeau n'est pas suffisant pour couvrir le montant de l'achat, la différence peut être payée par tout autre moyen de paiement accepté par le point de vente concerné.
Chaque fois que la Carte Cadeau est utilisée, le solde restant sur celle-ci sera imprimé sur le reçu émis pour l'achat correspondant.
Date d'expiration
La Carte Cadeau peut être utilisée pendant douze (12) mois à partir de l'activation, s'agissant de la date imprimée sur le reçu pour l'émission de la Carte Cadeau elle-même. Après la date d'expiration, la Carte Cadeau ne peut plus être utilisée ou rechargée, et le détenteur n'aura aucun droit au remboursement de tout avoir résiduel sur celle-ci.
Droit applicable
L'achat et l'utilisation de la Carte Cadeau impliquent l'acceptation des conditions générales d'utilisation mentionnées ci-dessus. L'Émetteur se réserve le droit de modifier et/ou amender les présentes conditions générales à tout moment, à son entière discrétion.
Tout litige résultant de ou en relation avec l'utilisation de la Carte Cadeau sera régi par le droit luxembourgeois.
GESCHENKKARTEN - ALLGEMEINE NUTZUNGSBEDINGUNGEN
Ausstellung
Die Geschenkkarte wird durch die Tod’s Luxembourg S. A. eine Gesellschaft nach luxemburgischem Gesetz mit eingetragenem Sitz in 4, Avenue de la Porte Neuve, L-2227 Luxembourg, USt.ID Nr. LU20829232 (nachfolgend die "Ausstellende Partei" genannt) ausgestellt.
Die Geschenkkarte wird durch eine Verkaufsstelle der Ausstellenden Partei ausgestellt und aktiviert nach Zahlung eines Betrages von bis zu € 3.000 (Dreitausend EURO) in Form einer Barzahlung oder auf andere durch die betreffende Verkaufsstelle akzeptierte Weise. Weitere Kosten werden für die Aktivierung und Nutzung nicht erhoben. Die Verkaufsstelle ist die folgende: Tod’s Luxembourg.
Nach der Aktivierung der Geschenkkarte an den Kassen der vorstehend genannten Verkaufsstellen und nach Zahlung des gewählten Betrages erhält der Kunde einen Beleg, aus dem der verfügbare Betrag hervorgeht. Auf den verfügbaren Betrag der Geschenkkarte fallen keine Zinsen an.
Typ
Die Geschenkkarte ist ein Gutschein, dessen Wert im Rahmen einer einfachen Finanztransaktion in dem Maße abnimmt, wie die Geschenkkarte genutzt wird. Der jeweils für die Geschenkkarte eingezahlte Betrag enthält keine Mehrwertsteuer, da die Transaktion einen Bargeldtransfer darstellt.
Die Geschenkkarte repräsentiert ein Guthaben des Inhabers und ist als solche ein Bargeldäquivalent. Aus diesem Grund muss die Geschenkkarte sehr sorgsam verwahrt werden, da sie durch alle Personen eingesetzt werden kann, in deren Besitz sie gelangt. Die obengenannten Verkaufsstellen sind nicht verpflichtet, die Identität der Person, die die Geschenkkarte nutzt, zu überprüfen. Die Ausstellende Partei und die besagten Verkaufsstellen lehnen ausdrücklich jede Haftung ab, darin eingeschlossen jede Haftung für den Fall einer unlauteren Nutzung, eines Diebstahls oder eines Verlusts der Geschenkkarte. In derartigen Fällen wird die
Geschenkkarte nicht ersetzt, und das darauf verfügbare Guthaben wird nicht erstattet, sondern ist dauerhaft verfallen.
Nutzung
Die Geschenkkarte darf nur für den Kauf von Produkten im Rahmen einer oder mehrerer Transaktionen in einer der oben benannten Verkaufsstellen der Ausstellenden Partei genutzt werden.
Die Geschenkkarte kann so lange für Käufe genutzt werden, bis das Guthaben der Karte vollständig aufgebraucht ist. Die Bezahlung eines Teiles des Kaufpreises mittels der Geschenkkarte ist ebenfalls möglich. Bei jeder Nutzung der Geschenkkarte verringert sich das Guthaben um den entsprechenden Betrag, und das verbleibende Guthaben steht für weitere Käufe zur Verfügung. Falls das über die Geschenkkarte verfügbare Guthaben nicht zur Deckung des Kaufbetrages ausreicht, kann der Differenzbetrag unter Verwendung jedes sonstigen durch die betreffende Verkaufsstelle akzeptierten Zahlungsmittels beglichen werden.
Das verbleibende Guthaben wird jedes Mal auf den Kassenbeleg, welcher unter Verwendung der Geschenkkarte ausgestellt wird, gedruckt.
Verfall
Die Geschenkkarte kann innerhalb eines Zeitraums von 3 Jahren nach Aktivierung genutzt werden. Für die Aktivierung gilt das Datum der Ausstellung der Geschenkkarte. Nach dem Ablaufdatum kann die Geschenkkarte weder weiter genutzt noch aufgeladen werden, und der Inhaber hat keinen Anspruch auf Erstattung eines darauf eventuell befindlichen Restguthabens.
Maßgebendes Recht
Mit dem Erwerb und der Verwendung der Geschenkkarte akzeptiert der Käufer die vorstehenden Nutzungsbedingungen. Die Ausstellende Partei behält sich das Recht vor, die vorstehenden Nutzungsbedingungen jederzeit in eigenem Ermessen zu ändern und/oder zu ergänzen.
Auf jegliche Streitigkeiten, die sich unter Umständen im Zusammenhang mit der Nutzung der Geschenkkarte ergeben, ist luxemburgisches Recht anzuwenden.

Issue
The Gift Card is issued by Tod's International BV, a company duly incorporated in Netherland with registered office at P.C. HOOFTSTRAAT, 74, LH 1079, Amsterdam, (hereinafter referred to as the "Issuer")
The Gift Card is issued and activated solely at such sales points participating in the initiative as identified by the Issuer and upon payment, in cash or by any other means of payment accepted by the said sales point, of a an amount up to € 3,000.00 (Three Thousand/00 Euro). No additional cost is requested for activation and use. The participating sales points are the following: Tod's Amsterdam.
After activating the Gift Card at the cash desk of the aforementioned sales points and having paid the chosen amount, the Customer will be given an issue receipt indicating the amount available on the Gift Card. No interest shall accrue on the amount available on the Gift Card.
Type
The Gift Card is a voucher with a value that progressively decreases as the Gift Card is used, acting as a simple financial transaction; the concerned sum paid for the Gift Card is exempt from VAT since the operation is classified as a transfer of cash.
The Gift Card represents the holder's right to credit and, as such, it is equivalent to cash. For this reason, the Gift Card must be kept with great care, since it can be used by anyone who obtains possession of it. The sales points as listed hereinabove are not obliged to check the identity of the person using the Gift Card. The Issuer and the said sales points explicitly decline all liability, for example, but not limited to, the event of improper use, theft, or loss of the Gift Card. In such circumstances, the Gift Card will not be replaced and the available credit therein will not be reimbursed but permanently forfeited.
Use
The Gift Card shall be used exclusively for the purpose of buying products, in one or more transaction, from the Issuer's designated sales points which participate in the initiative.
The Gift Card can be used for purchases until the credit available on the card is completely consumed, or for the partial payment of a purchase. Every time the Gift Card is used, the credit will be decreased by the corresponding available amount, and any remaining credit will be available for future purchases. If the credit available on the Gift Card is not enough to cover the amount of the purchase, the difference can be paid by any other means accepted by the concerned sales point.
Every time the Gift Card is used, the remaining balance therein will be printed on a receipt to be issued for the respective purchase.
Expiry
The Gift Card can be used for 12 months starting from the time of activation, being the date printed on the receipt for the issue of the Gift Card itself. After the expiry date, the Gift Card cannot be longer used or re-charged, and the holder will have no right to the reimbursement of any residual credit thereinto.
Governing law
The purchase and use of the Gift Card implies the acceptance of the aforementioned terms and conditions of use. The Issuer reserves the right to modify and/or amend these terms and conditionsat any time at its own discretion.
Any dispute arising out of or in connection with the use of the Gift Card shall be governed by Dutch law.
GESCHENKBON - Algemene gebruiksvoorwaarden
UITGIFTE
Deze Geschenkbon wordt uitgegeven door Tod's International BV, een vennootschap gevestigd in Nederland met statutaire zetel te P.C. HOOFTSTRAAT 74, LH 1079 Amsterdam (hierna vernoemd als de 'Uitgever').
De Geschenkbon wordt uitsluitend uitgegeven en geactiveerd in verkooppunten die deelnemen aan het initiatief, zoals vastgesteld door de Uitgever, en tegen betaling in cash of een ander door het verkooppunt geaccepteerd betaalmiddel, voor een maximum bedrag van EUR 3.000,00 (drieduizend EURO). Er worden geen extra kosten in rekening gebracht voor de activering en het gebruik ervan. De deelnemende verkooppunten zijn: Tod's Amsterdam.
Na activering van de Geschenkbon bij de kassa van de hiervoor genoemde verkooppunten en na betaling van het gekozen bedrag, zal de klant een ontvangstbewijs ontvangen waarop het beschikbare krediet van de Geschenkbon is vermeld. Er is geen rente verschuldigd over het beschikbare krediet op de Geschenkbon.
TYPE
De Geschenkbon is een tegoedbon waarvan de waarde geleidelijk afneemt naarmate de Geschenkbon wordt gebruikt, functionerend als een eenvoudige financiële transactie. Over het aankoopbedrag van de Geschenkbon is geen BTW verschuldigd omdat de transactie wordt aangemerkt als een cash betaling.
De Geschenkbon geeft de houder recht op krediet en is, als zodanig, gelijk aan cash geld. Daarom is het belangrijk dat er zorgvuldig met de Geschenkbon wordt omgegaan, want deze kan door iedereen worden gebruikt die hem in zijn of haar bezit krijgt. De hierboven genoemde deelnemende verkooppunten zijn niet verplicht om de identiteit van de persoon, die de Geschenkbon gebruikt, te controleren. De Uitgever en de genoemde verkooppunten wijzen nadrukkelijk alle aansprakelijkheid af, bijvoorbeeld, maar niet beperkt tot, gevallen van oneigenlijk of illegaal gebruik, diefstal of verlies van de Geschenkbon. In dergelijke gevallen zal de Geschenkbon niet worden vervangen en zal het beschikbare krediet daarop niet worden vergoed, maar permanent verbeurd worden verklaard.
GEBRUIK
De Geschenkbon kan uitsluitend gebruikt worden voor de aankoop van producten, in één of meer transacties, bij een door de Uitgever aangegeven verkooppunt dat deelneemt aan het initiatief.
De Geschenkbon kan worden gebruikt voor aankopen totdat het beschikbare krediet op de Geschenkbon volledig besteed is, of voor de gedeeltelijke betaling van een aankoop. Bij elk gebruik van de Geschenkbon zal het beschikbare krediet worden verminderd met het overeenkomstige bedrag van de aankoop en blijft het eventueel resterende krediet beschikbaar voor toekomstige aankopen. Als het beschikbare krediet op de Geschenkbon onvoldoende is om het bedrag van de aankoop te dekken, kan het verschil worden betaald in cash of een ander door het verkooppunt geaccepteerd betaalmiddel.
Bij elk gebruik van de Geschenkbon, zal het resterende krediet worden afgedrukt op het ontvangstbewijs voor de betreffende aankoop.
VERVALDATUM
De Geschenkbon kan gebruikt worden gedurende twaalf (12) maanden vanaf het moment van activering, zijnde de datum vermeld op het ontvangstbewijs voor de uitgifte van de Geschenkbon zelf. Na de vervaldatum kan de Geschenkbon niet meer worden gebruikt of opgeladen en heeft de houder geen recht op terugbetaling van het eventueel resterende krediet op de Geschenkbon.
TOEPASSELIJK RECHT
De aankoop en het gebruik van de Geschenkbon houdt in dat de hier genoemde algemene gebruiksvoorwaarden worden aanvaard. De Uitgever behoudt zich het recht deze algemene gebruiksvoorwaarden op elk moment naar eigen goeddunken te wijzigen.
Op de eventuele geschillen die voortvloeien uit of verband houden met het gebruik van de Geschenkbon is het Nederlandse wetgeving van toepassing.

Die Ausstellende Partei und die besagten Verkaufsstellen lehnen ausdrücklich jede Haftung ab, darin eingeschlossen jede Haftung für den Fall einer unlauteren Nutzung, eines Diebstahls oder eines Verlusts der Geschenkkarte. In derartigen Fällen wird die Geschenkkarte nicht ersetzt, und das darauf verfügbare Guthaben wird nicht erstattet, sondern ist dauerhaft verfallen.
Nutzung
Die Geschenkkarte darf nur für den Kauf von Produkten im Rahmen einer oder mehrerer Transaktionen in einer der oben benannten Verkaufsstellen der Ausstellenden Partei genutzt werden.
Die Geschenkkarte kann so lange für Käufe genutzt werden, bis das Guthaben der Karte vollständig aufgebraucht ist. Die Bezahlung eines Teiles des Kaufpreises mittels der Geschenkkarte ist ebenfalls möglich. Bei jeder Nutzung der Geschenkkarte verringert sich das Guthaben um den entsprechenden Betrag, und das verbleibende Guthaben steht für weitere Käufe zur Verfügung. Falls das über die Geschenkkarte verfügbare Guthaben nicht zur Deckung des Kaufbetrages ausreicht, kann der Differenzbetrag unter Verwendung jedes sonstigen durch die betreffende Verkaufsstelle akzeptierten Zahlungsmittels beglichen werden.
Das verbleibende Guthaben wird jedes Mal auf den Kassenbeleg, welcher unter Verwendung der Geschenkkarte ausgestellt wird, gedruckt.
Verfall
Die Geschenkkarte kann innerhalb eines Zeitraums von 3 Jahren nach Aktivierung genutzt werden. Für die Aktivierung gilt das Datum der Ausstellung der Geschenkkarte. Nach dem Ablaufdatum kann die Geschenkkarte weder weiter genutzt noch aufgeladen werden, und der Inhaber hat keinen Anspruch auf Erstattung eines darauf eventuell befindlichen Restguthabens.
Maßgebendes Recht
Mit dem Erwerb und der Verwendung der Geschenkkarte akzeptiert der Käufer die vorstehenden Nutzungsbedingungen. Die Ausstellende Partei behält sich das Recht vor, die vorstehenden Nutzungsbedingungen jederzeit in eigenem Ermessen zu ändern und/oder zu ergänzen.
Auf jegliche Streitigkeiten, die sich unter Umständen im Zusammenhang mit der Nutzung der Geschenkkarte ergeben, ist Schweizer Recht anzuwenden.
